Terms of Use

Please read the safety section. VERT is a companion for a day in the mountains, not a safety instrument. Do not navigate by it and do not rely on it in an emergency.
1. The agreement
These terms govern your use of the VERT iPhone app, published by Nadzeya Yashchuk, Wals-Siezenheim, Austria (see the Impressum). By installing or using the app you accept them. The app is also subject to Apple's standard licence terms for App Store applications.
2. Licence
You get a personal, non-exclusive, non-transferable licence to use VERT on devices you own or control. You may not resell it, rent it, decompile it or attempt to extract its source, except to the extent Austrian or EU law expressly permits.
3. Safety — this matters more than the rest
VERT measures altitude with the iPhone's barometric sensor and shows the uncertainty the system reports. That figure is good enough to enjoy, and not good enough to bet your life on. Barometric altitude changes with the weather; GPS position can be wrong, absent or delayed; a phone can lose power, get wet or break.
- Do not use VERT for navigation, route-finding or descent decisions.
- Do not use it as an avalanche, weather or terrain safety tool.
- Do not use it as your only means of orientation or of calling for help.
- Always carry a map, a compass and a charged means of emergency communication, and check the official avalanche and weather bulletins.
Mountains are dangerous and you take part at your own risk. You are responsible for your own decisions, your fitness, your equipment and your companions.
4. Purchases
VERT is free to use. VERT Pro is an optional one-time in-app purchase, sold and processed by Apple — not by me. It is a permanent unlock, not a subscription, and it can be restored on your other devices with the same Apple ID. Refunds are handled by Apple under their terms; I cannot issue them myself, but write to me if something is wrong and I will do what I can to help.
5. Advertising
The free version shows advertising on the day summary and the logbook only, never on the altimeter or during recording. VERT Pro removes it. Ads are served by Google; I do not control which ads are shown and am not responsible for their content or for anything you find beyond a link in them.
6. Your data is yours — and only yours
Everything you record stays on your device. There is no cloud backup, so if you delete the app, lose the phone or reset it, your recorded days are gone. Please export anything you want to keep — GPX export is free, and always will be. I cannot recover data for you, because I never had it.
7. Availability and changes
The app is provided as it is at the time you install it. I improve it over time and may change or remove features; features that are free today will not be moved behind the paywall for people who already have the app. Third-party services the app relies on — Apple's, Google's — may change independently of me.
8. Liability
VERT is provided without warranty of any kind, to the extent permitted by law. I am liable for damages caused intentionally or by gross negligence, and for injury to life, body or health, under mandatory Austrian law. Liability for slight negligence is excluded except where a material contractual obligation is breached, and is then limited to foreseeable, typical damage. Statutory consumer rights are not affected by any of this.
9. Governing law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of your country of residence, and you may bring proceedings in your own courts.
